Wired News: P2P Services in the Clear

The U.S. 9th Circuit Court of Appeals has upheld a District Court ruling that Peer-to-Peer (P2P) services are not to be held liable for the nefarious activities of it's users. This case was pretty clear cut, going all the way back to the VHS/Betamax days. For some reason, people thought that because this was new technology that it was somehow different.

Unfortunately, there is one fairly major stepping stone ... the INDUCE Act would change the law, making this ruling moot until challenged at the Supreme Court level. Then you have to get the court to HEAR the case, and then they have to render the INDUCE Act unconstitutional or otherwise invalid.

This is a good step, but there's a long road ahead of us.
